Why Vote NO on 4?

The deceptive language of Amendment 4 goal will allow unsafe, unrestricted, unregulated abortion on demand UP TO BIRTH without parental consent as determined by someone who does not have to be a physician with medical training.

If Amendment 4 is passed:

  • Abortion in Florida would be legal up to “Viability” (23-24 weeks gestation)
  • Abortion in Florida would be legal up to birth, with the consent of a “healthcare provider” (not necessarily a doctor)
  • Minors would NOT need parental consent

What does the Amendment say?

Amendment 4 – the Amendment to Limit Government Interference in Abortion – states the following:

“No law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider. This amendment does not change the Legislature’s constitutional authority to require notification to a parent or guardian before a minor has an abortion.”

What is wrong with this Amendment?

Unlike other Amendments, Amendment 4 provides ZERO definitions of key words like “government interference”, “viability”, “health care provider”, “patient’s health” – so voters won’t even know what they’re voting on. This creates loopholes that will result in years of litigation and legal uncertainty.

Amendment 4 gives abortion clinics a rubber stamp to approve late-term, third trimester abortions. That’s because Amendment 4’s “Health Care Provider(s)” aren’t just doctors but could be any one of dozens of health-intersecting occupations licensed by the state. Even abortion clinic staffers who aren’t doctors would have the authority to decide if the baby is viable or if a health concern or complaint was significant enough to approve a full-term abortion.

Amendment 4 would make abortion the only medical procedure that minors could undergo without parental consent. Its tricky wording gives the impression that existing parental consent laws would remain in force but read it closely – it only preserves parental notification, not parental consent laws, which Amendment 4 would eliminate.

How should I vote on Amendment 4?

Vote NO.

The Florida Heartbeat Protection Act is Florida’s current abortion law and what will continue if we vote down Amendment 4 in November.

What is legal today?

As of May 1st, 2024, abortion in Florida is illegal past 6-weeks gestation.

Though the law is technically called the Heartbeat Protection Act, it limits abortion based on gestational age, not when a heartbeat is detected. Abortion is legal up to 6-weeks gestation. Amendment 4 will override this law.

What about miscarriages and ectopic pregnancies?

Today, miscarriages and ectopic pregnancy care are not abortions, and women will not be denied medical care for miscarriages or ectopic pregnancy.

What about the abortion pill?

As of today, the abortion pill must be administered in person by a physician, outlawing the dispensing of the pill through mail. Amendment 4 will remove this barrier.

What about rape and incest?

Today, exceptions to the law exist in cases of rape, incest, human trafficking, fatal fetal abnormality, or when the pregnant woman’s life is in danger.

Can a woman be prosecuted for an abortion?

Abortion providers administering the abortion pill or surgical abortions after 6-weeks gestation may be prosecuted, not the woman seeking an abortion.
